Rubbishing the Congress' allegations that Madhya Pradesh government had presented a weak prosecution in the case of Prof H S Sabharwal to ensure acquittal of the accused, BJP today said the case was tried outside MP as per demand of the victim's family.

The party categorically said that since the case was tried in a non-BJP ruled state the Madhya Pradesh government could not be held responsible for any complicity in the acquittal of the accused. "The family of HS Sabharwal said it would not get justice in a BJP-ruled state and had demanded that the trial should be held in a non-BJP ruled state. So, with the high court's permission the case was tried in a Nagpur court," deputy leader of opposition in Rajya Sabha, SS Ahluwalia told reporters.

He said since the verdict was announced by a Maharashtra court, BJP could not be held responsible. A Congress-NCP government is in power in Maharashtra. All accused are activists of BJP's youth ABVP and were acquitted for want of evidence.

Earlier, Congress had slammed BJP-ruled Madhya Pradesh government for presenting a weak prosecution in the case to ensure acquittal of the accused. Sabharwal, head of Political Science Department of
Madhav College, Ujjain, died in August 2006, when he was allegedly beaten up by ABVP activists over student union elections.
