With reference to Rajesh Adani case, Justice Anant Dave of Gujarat high court on Tuesday pulled up registrar (judicial) GK Upadhyay, saying that "rich and powerful people can't take up their cases urgently overlooking the administerial process laid down by the high court".

Upadhyay was summoned by the judge after he allowed to move the case of Rajesh Adani before Justice Dave's court by showing "unnecessary haste". Justice Dave sought an explanation as to under whose permission he had allowed to circulate the case before his court.

"With whose permission or an order of the high court you have allowed to move a case before this court? You should give me in writing," the angry judge said to the officer. "I am surprised how the case can reach before me without any endorsement of the chief justice, in the absence of any order of the bench or permission of this court," said justice Dave.

Registrar Upadhyay tried to convince the judge with folded hands and said that he had no motive behind putting the case before him urgently. When the officer failed to convince the judge properly, Justice Dave started dictating an order mentioning the whole conduct of the registry of the high court. At that point of time, registrar-general PP Bhatt rushed to Justice Dave and tried to convince him.

The whole issue came up after a bench of Justice Jayant Patel and Justice Rajesh Shukla asked the counsels of Rajesh Adani to move a particular application before the appropriate judge. The application sought quashing of complaint filed by the CBI against Adani, under Article 226 of the Constitution. The counsels immediately approached the registry to forward their case before the appropriate judge (Justice Dave). According to norms, such cases can be put before the appropriate judge only after taking due permission of the chief justice, apart from following other stipulated provisions. But in case of Rajesh Adani, the case was immediately taken up by the registry and forwarded to the court of Justice Dave.
