A show cause notice has been issued to Railways for carrying out unauthorised construction in the prohibited area near ancient Mughal-era monument Humayun Tomb, the government today said.

The Archaeological Survey of India (ASI) had accused Northern Railways of constructing a building within 100 metres of the centrally protected monument Neela Gumbad, which lies next to Humayun's Tomb.

"Soon after observing unauthorised construction activity at the site in the prohibited area of Neela Gumbad, a centrally protected monument, a show cause notice was issued to the deputy chief engineer (construction), Northern Railways," minister of state for planning and parliamentary affairs V Narayanasamy told Lok Sabha in a written reply.

"Police were also requested to get the unauthorised construction stopped," said the minister on behalf of Prime Minister Manmohan Singh who holds the Culture portfolio.

Narayanasamy said the Railways were apprised about the provisions of Ancient Monuments and Archaeological Sites and Remains (Amendment and Validation) Act, 2010 and were asked not to undertake any construction that may amount to violation of the law in force.

On the steps taken by ASI to free the world heritage site from encroachment, the minister said, "The ASI has put in place an appropriate mechanism for strict watch to thwart any attempt of encroachment at the site, as per the available manpower resources."

In December last year, the ASI had filed an FIR against the Railways for illegal construction within protected zone of the centrally protected monument. According to ASI, the building was meant to be a Railways guest house.
