A Delhi court has sought response from the family of an undertrial, who died under 'mysterious' circumstances in Tihar jail, after the CBI filed a closure report in the five-year-old case.

Additional chief metropolitan magistrate RK Tripathi issued notice to Bilkis Begum, widow of deceased Mobin alias Momin (35) as the probe agency claimed that investigations did not corroborate the allegation that he was murdered.

The probe agency had registered a regular case on August 27, 2007, after a direction by the Delhi High Court on a petition of Bilkis alleging her husband, who was an undertrial in a murder case, was electrocuted inside Tihar jail on August 13, 2004.

The CBI on July one filed a closure report stating, "there is no direct or circumstantial evidence to suggest the murder (of Mobin). Most of the witnesses rebut the opinion that he was electrocuted in the jail barracks".

Bilkis had alleged her husband was murdered following a conspiracy hatched by Noora, Hakimuddin and one Khalil, who were jail inmates, in connivance with the prison staff.

"During the investigation conducted so far, neither any evidence nor any allegation surfaced which could lead to the conclusion that it was a case of homicide amounting or not amounting to murder," said the CBI, which examined 68 witnesses during its probe.

The board of doctors, that conducted the post-mortem on the body of Mobin, had opined that his death was caused due to "combined result of shock and blunt force impact to head and genital organs."

The CBI referred the findings of the post-mortem to AIIMS forensic department which said it could not give any further opinion on the available information.

The probe agency recorded the statements of 40 out of 114 inmates who were then present inside his barrack as witnesses who, it claimed, denied foul play in the incident.

It even claimed that Bilkis and others recorded their statement before it and could not provide any clue relating to the death of Mobin.

Interestingly, the CBI went on to claim in its report that "investigations disclosed that Mobin was indulging in illicit trade of tobacco, cigarettes and possibly narcotics in the jail with the connivance of jail staff".
