How CBI built up case against Abhay Chudasama

Well begun is half done. That is what exactly the CBI did to strengthen the case against deputy commissioner of police Abhay Chudasama.

The probe agency knew well the significance of recording the statements before a magistrate of under section 164 of CrPC.  Under this section, a judicial magistrate, irrespective of his jurisdiction in the case, can record a confession or statement made to him during the course of an investigation.

So the CBI did a few simple things. It convinced the witnesses to voluntarily record their statements. The agency booked flight tickets for them to from Ahmedabad to Mumbai, took them to a metropolitan magistrate in Mumbai, where the witnessed recorded their statements. After the recording of the statements, the witnesses were brought back to Ahmedabad.

The CBI did this before arresting Chudasama. Sources also said that of the total 15 witnesses against Chudasama, 14 recorded their statements before the magistrate in Mumbai, while one did it before a metropolitan magistrate in Pune. All the witnesses reportedly did it willingly.  According to advocate Kailash Tamaichi, said that such statement is considered final.
