Gujarat chief justice opens mediation centres in Surat

Strongly advocating use of mediation to resolve disputes, chief justice of Gujarat High Court, KS Radhakrishnan inaugurated two mediation centres in Surat on Saturday. The first mediation centre was inaugurated in the district court building and the second one in The Southern Gujarat Chamber of Commerce & Industry.

"The monopoly of courts to resolve disputes is no longer there, due to less expensive and less time consuming means like mediation," the chief justice said while inaugurating the centre at the chamber. This was justice Radhakrishnan's first visit to Surat. Disputes related to intellectual property rights, joint venture agreements, trademarks, works contract, among others can be resolved by mediation.

While stating that a large number of cases are pending in various courts, the chief justice further said, "The mediation route for resolving disputes will not only be beneficial for the disputing parties but for us too as number of cases coming to courts will go down and our workload will be lesser."

Praising the business acumen and entrepreneurial skills of Gujaratis, justice Radhakrishnan, who has been elevated to the Supreme Court, suggested that all business contracts, including those involving government agencies, should contain a specific clause that any arising disputes will be resolved through mediation.

"This will help in easier and faster resolution of disputes," he said. He also said that courts for exclusively dealing in cheque bounce cases are under consideration. Earlier, justice Mohit Shah, senior-most judge in Gujarat High Court, who is slated to take over as chief justice of Patna High Court, said proper legal infrastructure is also one of the necessities for industrial development.

"(Resolving disputes through) mediation makes business sense, please accept it," he told a gathering of lawyers and prominent citizens at The Southern Gujarat Chamber of Commerce & Industry. Justice Shah also said that there were many misunderstandings regarding the functioning of the judiciary.
