Four persons acquitted in murder case in Delhi

A Delhi court has acquitted four persons accused of robbing and stabbing to death a man behind the famous Lotus Temple here in 2004, saying the prosecution failed to establish the motive behind the murder.
 
"The prosecution could not establish the complete chain of circumstances in the case, while it is well settled principle of law that in such cases, each and every circumstance has to be proved by unimpeachable, legal and reliable evidence," additional sessions judge SC Rajan said.
 
The court absolved Wazid, Amit, Mobin and Vishal -- all hailing from Lajpat Nagar here -- of charges under section 302 (murder) and 396 (murder during dacoity) of the IPC.
 
The court said the prosecution could not prove that the accused had a motive to kill and they were last seen with the victim before the commission of offence.
 
"The forensic test and other reports did not support the case. The measurement of knives, recovered at the instance of accused Wazid and Mobin, did not match up with the wounds of the victims," it said while giving benefit of doubt to the accused.
 
The body of Jagdish was found lying in a pool of blood behind the Lotus Temple in south Delhi on September 29, 2004.
 
Some of the belongings of the victim were also lying near his body, the prosecution said.
 
During the probe, the accused allegedly confessed their complicity in the offence and had also led to the recovery of two knives.
 
The court, in its judgment, said that the nature and measurement of wounds did not suggest that they were caused by the recovered knives.
 
It also highlighted various other lapses in the prosecution's argument.
