Dr Narendra Amin clarifies his approver stance

Dr Narendra Amin, one of the accused in the Sohrabuddin Sheikh fake encounter case, on Friday filed an application before special CBI magistrate, in connection with the statements made by the magistrate telling Amin of the consequences if he gives a confession statement.

In the application filed by Amin, he said that he has clearly stated that he does not intend to give any confession statement under Sec 164 of CrPC. But that he has agreed to give statement under Sec 306 as a witness and seeking pardon in the case. Hence, there is no issue of confessing the alleged crime or allegation, the application states.

Amin in his application stated that the CBI magistrate on several occasions have told him that if he gives a confession statement, it may be used against him and he may be convicted for life term or death penalty.

"Hence the court gives you few more days to think over the decision," the magistrate had told Amin, according to the application. Amin in the petition said he was shocked to hear such statements.

The application further states that such statements and use of words like life term and capital punishment is sufficient enough to imbalance his mental status. Amin has in his application further reiterated that he does not intend to give any confession statement but that he will give statement as a witness under sec 306.

"I have filed the application to clarify my stand as against the frequent warnings given by the court using such words to explain me the meaning of confession statement under sec 164 (2)," said Amin’s application.

"I have never made any representation that I want to give a confession statement. This kind of statements given by the court and mention of confession statement disturbs my mental condition," states Amin in his application.
