9 accused in 2006 Malegaon blast case get bail

Nine accused in the 2006 Malegaon bomb blast case today got bail as National Investigation Agency (NIA) chose not to oppose their plea for liberty.

In March, special judge YD Shinde turned down the bail plea application of the nine accused alleged of conspiring and executing the 2006 Malegaon blast case.

He had observed: “They (accused) could have and they should have waited for the result of the inquiry.”

The bail pleas had relied heavily on the confessional statement of Swami Aseemanand alias Naba Kumar Sarkar, who in his confessional statement given to the Delhi police, allegedly said that the 2006 Malegaon blast was done by Hindu extremist.

On Saturday, the court granted bail to all of them on a personal bond of Rs50,000 each and directed them to be present in the court as and when required. The bail order also states that they should not tamper with the evidence. The most important factor behind the accused being released is the reply filed by the National Investigating Agency (NIA), which did not oppose the bail applications of the accused.

Their reply filed by special counsel Rohini Salian said: “During the course of further investigation, NIA after revelation of Swami Assemanand arrest in Mecca Masjid bomb blast case reviewed the connected evidence and fresh evidence, in the form of documentary and oral evidence. Investigations have brought out several new facts and circumstances, in the form of statements and forensic report. Further investigation is in progress to collect more evidence for arriving at definite investigation conclusion. Thus there is no opposition to their bail plea.”  

Of the nine accused, Shaikh Mohammed Ali Alam Shaikh and Asif Khan Bashir Khan alias Juned alias Abdulla, will not walk free as they have been accused in the ongoing serial train blasts case of 2006. Advocate Jaleel Ahmed and Khalid Azmi, appearing for the accused had argued in court that “as per the confessional statement of Swami Aseemanand, a key accused in the

Samjhauta blasts case, the role as alleged by CBI does not stand and they are being unnecessarily kept in custody for the last four years, pending trial”.
