The Bruhat Bangalore Mahanagara Palike (BBMP) elections may finally be over, but legal issues are now plaguing the mayoral elections. The poll to the posts of the mayor and deputy mayor was scheduled for April 23, but the entire process has now been challenged.
The Karnataka Pradesha Kurubara Sangha and HC Shivanna filed a public interest litigation (PIL) in the high court challenging the change in reservation.
A division bench of justices Manjula Chellur and Mohan Shantanagoudar admitted the PIL and ordered notices to the Urban Development Department (UDD) and the Palike commissioner, and adjourned the case to April 21.
The petitioners contended that a February 15, 2010, notification by the UDD had reserved the mayor’s post for Backward Castes A, and that of the deputy for general category candidates.
“On February 15, 2010, the UDD issued a notification reserving the mayor’s post for BC-A and the deputy mayor’s post for the general category. But after the elections, the state government changed the reservation to a general candidate for the mayor’s post and Scheduled Castes for the deputy mayor post. It is illegal and unconstitutional,” the petitioner’s counsel submitted.
He contended that the state government had no power to change the reservation after the guidelines were issued. “The state government has to follow Article 243(T) of the Indian Constitution and the Karnataka Municipalities Act, 1976, to make changes in the reservation. By changing the reservation to suit itself, the state is depriving a BC-A candidate from becoming the mayor of Bangalore,” he submitted.
