The Karnataka high court today dismissed the anticipatory bail plea of Abdul Naseer Madani in the 2008 Bangalore serial blasts case, observing that a prima facie has been made out against the Kerala-based People's Democratic Party leader.

In his order, justice N Ananda described the blasts as a 'terrorist act' and said he was rejecting the bail plea considering the seriousness of the offences committed by Madani, who is an accused.

The judge said the offences committed by Madani came under the purview of the Unlawful Activities Act of 1967 and therefore "in view of the internal security and interest of the nation" the plea was being rejected.

The Court rapped the investigating officer for issuing notice to Madani under section 91 of the CRPC (relating to summons to produce document or other thing) which was "not warranted when there was concrete evidence to arrest him".

Observing that "this (issue of notice) betrays the ignorance of the investigating officer about the provisions of the CRPC", the judge directed the officer to take adequate care about the accused if he was arrested due to his being handicapped and his ailments.

On July 9, a fast track court dismissed Madani's anticipatory bail plea on the grounds that there was "no prima facie case" to grant him relief. Madani moved the high court seeking anticipatory bail on July 22.

Madani, along with 31 others, was issued charge sheet for his alleged involvement in the blasts at Bangalore that left a woman dead and 20 injured on July 25, 2008.

The PDP leader was also an accused in the 1998 Coimbatore serial blasts case in which 58 people were killed. However, he was acquitted by the trial court.

Reacting to the verdict, Madani said the investigating agency was deliberately trying to implicate him in the case.

Talking to reporters at Kollam in Kerala, Madani said forces who wanted to see his end were behind it.

PDP sources said Madani might move the Supreme Court against the verdict.
