BBMP to demolish part of Brigade Gateway

The action comes after the builder failed to respond to a BBMP notice seeking details of the property, within a week.

The Bruhat Bangalore Mahanagara Palike (BBMP) has decided to demolish a part of the Brigade Gateway building at Rajajinagar, which had been constructed allegedly on an encroached storm water drain. The action comes after the builder failed to respond to a BBMP notice seeking details of the property, within a week.

A BBMP official said, “Even though the notice was sent to the builders seeking information, they have not bothered to provide any details to BBMP. They are taking the notice lightly. If they had not encroached upon the storm water drain, they would have given the details within one week. However, the village survey and another recent report claim that they have encroached upon the BBMP property. The builders are deliberately using dilatory tactics.”

BBMP commissioner Siddaiah said, “The Brigade Gateway has failed to provide details which were sought by the BBMP. We have to proceed under the law and remove the encroachment. We will take suo motu action against Bridge Gateway and demolish the structures encroaching  upon the storm water drain.”

But Mathew Abraham, deputy general manager and spokesperson for Brigade Group, said the company did not receive any notice from BBMP. “To my knowledge, there has been no notice from the civic authorities in this regard,” he said.

The controversy
On December 4, 2010, members of the BBMP standing committee for major works, led by  H Ravindra, inspected the Brigade Gateway building and found that they were constructing the commercial and residential enclave by encroaching upon the storm water drain which passed in the middle of the property.

Ravindra said the builder had also blocked the drain and diverted it towards the residential areas. Due to this, during monsoon, there used to be flooding in Subramanyanagar and surrounding areas. The committee ordered a survey of the area to verify whether the drain passed inside the property.

A two-member BBMP team surveyed the property and reported that the storm water drain passed in the middle of the property and the builder had encroached upon it.  After obtaining the report, BBMP served notice on February 9 to Brigade Enterprise Private Limited, asking it to file details regarding the owner of property within seven days.

BBMP also sought information on building sanction plan, survey number and area, sale deed, khata extract and other details.
