Discrepancies between the revelations made by the Mumbai crime branch on 11/7 blasts and the chargesheet filed by the Anti-terrorism Squad (ATS) in the case could have serious repercussions on the case trial in the special MCOCA court, legal experts have opined.

While the chargesheet filed by the ATS in the 11/7 case speaks of nine absconding Pakistani bombers, the Mumbai crime branch recently said that the five arrested persons — alleged members of the Indian Mujahideen (IM) — were part of the same group of the Pakistani bombers.

The alleged IM members arrested include Afzal Usmani, Mohammed Sadiq Shaikh, Mohammed Arif Shaikh, Mohammed Zakir Shaikh and Mohammed Ansar Shaikh. Police said they were involved in the recent Delhi and Ahmedabad blasts.

Rakesh Maria, joint commissioner of police (crime) at a recent press conference, said that the absconding bombers were not Pakistanis, but members of the IM who ‘acted’ as Pakistanis. He said the crime branch could help the ATS in filing a supplementary charge sheet in the 11/7 case.

This revelation could contradict the ATS charge sheet, which specifically names seven Pakistanis and two unidentified Pakistanis who planted the bombs  with the five arrested accused in trains of Western railways. One of them is Sabir, who died in the Borivili blasts.
 
Raja Thakre, special public prosecutor in the 11/7 case, said he would comment on the revelations only when evidence is produced.

“The people who would get the benefit of the contradictions are the accused who have already been arrested. At the time of framing of charges, the court will have to decide which of the two reports is most probable and then proceed with the framing of charges,” said advocate Mubin Solkar.
