NEW DELHI: The Gurjar ball is back in the apex court. Who should be held responsible for the inconvenience caused due to the violent Gurjar protests, and the public property damaged in the process? The court will give its decision on June 19.

Petitioner Lakahan Singh, a resident of Rajasthan, has sought a direction to the Vasundhra Raje’s government to ensure that the agitators do not put people of the state to hardship. Can the agitators be allowed to affect normal life by disrupting exam schedules, break vital railway tracks and block traffic on the national highway, and hold the state and its citizens to ransom in the name of exercising democratic rights, asks Lakhan Singh’s counsel Pallav Shishodia.

He also questions the role of the BJP government in Rajasthan. The state government has failed to maintain law and order as it demonstrated incapacity to control the violent agitation by Gurjars in which state’s police stations were attacked and public properties destroyed openly.

Taking a serious note of making the Prevention of Damage to Public Property Act virtually useless despite national movable and immovable assets being destroyed in the violence, the supreme court had last year set up a committee to look into the efficacy of the enactment and to suggest measures for implanting sharp teeth to it.

During the hearing on the Gurjar violence issue, the court had termed it a ‘national shame’ as it sought details from the Centre and all the state governments regarding the cases registered under the property damage law since it’s inception in 1984. It may be pointed out that Mumbai Tada court judge recently convicted three accused in the 1993 serial blasts case under this law.
