Chennai surgeon seeks action against director of Maharashtra health services, police

MUMBAI: A prime accused in the international kidney transplant racket busted by Mumbai police last year, on Monday moved Bombay High Court seeking quashing of a private complaint filed against him by Prakash Doke, director of health services for Maharashtra, in October 2007.

Chennai nephrologist Dr P Ravichandran, currently out on bail, was arrested by the Mumbai crime branch on October 8, 2007. According to the police, Ravichandran is allegedly involved in executing as many as 760 illegal kidney transplants since 2002 and had earned over Rs500 crore in the process.

Ravichandran, in his petition, states that he is bound by the Tamil Nadu director of medical and rural health and they have already initiated action against him under the Human Organ Transplant Act, 1994 for his alleged involvement in the racket.

Ravichandran’s application before the court, however, takes exception to the complaint filed by Doke stating that as per the notification of the Maharashtra medical education and drugs department issued in March 1995, Doke, as the director of health services, has no authority over a hospital of a medical practitioner registered under a different state. The application also states that the police did not reveal the fact that the Tamil Nadu government has initiated action against him when he was produced before the magistrate in Mumbai after his arrest.

Ravichandran has urged the court to quash the complaint filed by Doke and the subsequent chargesheet filed by the police, as proceedings are already initiated in Tamil Nadu. While his advocate told the court that Doke had no authority to file this private complaint in the same case, additional public prosecutor Poornima Kantharia said that the main case against Ravichandran was registered in Mumbai.

Ravichandran has also prayed to the court for legal action against Doke and the police officers who have allegedly “misused their powers and misguided the court by not disclosing real facts”.

The court posted the case for further hearing in June.
