Pramod’s lawyers deem shooting cold-blooded, appeal for death sentence

MUMBAI: Calling the murder of former BJP leader Pramod Mahajan brutal and cold-blooded, the prosecution on Saturday pressed for a death sentence for his brother Pravin, who allegedly shot Pramod on April 22, 2006.

Drawing the court’s attention to established facts such as, that the pistol used to fire at Pramod was Pravin’s, and that Pravin voluntarily went to the police station and recorded his statement, and that Pramod’s death was deemed homicidal, special public prosecutor Niteen Pradhan said that the accidental death theory put forth by the defense was fabricated.

Pradhan argued that if it was a case of accidental firing, then why did Pravin not provide medical assistance to Pramod? He also pointed out that although Pravin came to Pramod’s Worli house in his car, he left his brother bleeding to death and instead went to the police station.

Stating that this reflected Pravin’s intention to kill, Pradhan said, “He (Pravin) deserves to hang and nothing else.”
As per the prosecution, the defense’s version of Pramod’s accidental death is an “after thought” and came at an advanced stage of the trial and not at the beginning.

While submitting his final arguments before the sessions court, Pradhan further relied on forensic evidence to support his argument. He pointed out to the court that as per the direction of the bullets revealed in the postmortem report of Pramod’s body, it is clear that Pravin was standing while Pramod was sitting. He ruled out the accidental firing version of the defense saying that the pistol has a slide-lock which requires some effort to unlock and both hands need to be used for it.

On Saturday, Pravin’s in-camera deposition was also discussed before the court while the prosecution put forth its stand. Pravin had apparently said that the argument stating that he did not wait to provide medical aid to Pramod was “absurd”.

Additional sessions judge Shrihari Davare will hear further arguments in the case on Monday.
