Fresh evidence against Haseena

The police on Wednesday for the first time produced a letter they say will prove the charge of cheating against Dawood Ibrahim’s sister, Haseena Parkar.

7 months later, police produce a letter that they say may act as evidence against her

Seven months after the complaint was filed and three months after a case for cheating was registered against Dawood Ibrahim’s sister, Haseena Parkar, the police on Wednesday for the first time produced a letter they say will prove the charge of cheating.

Principal judge AP Bhangale was hearing the prosecution on cancellation of Parkar’s bail on Wednesday when the police presented a letter dated September 4, 2006 from an SRA engineer to accused Krishnamilan and Sandeep Shukla, rejecting their offer to redevelop under SRA, the two impugned plots of land in Sion.

In the proceedings till now, before at least five different judicial officers, an equal number of prosecutors, including the then chief public prosecutor Rohini Salian, had never mentioned this letter. The presiding judicial officers had all noted the lack of evidence. “This letter shows that the accused (Parkar and seven others) cheated Avalani into parting with money though they knew that the project will never materialize,” argued the prosecutor.

“If the prosecution seeks to depend on this letter to prove that the bail must be reviewed, it will also have to prove that it had produced this letter before the previous presiding officer who granted bail. An order does not become wrong in law because the party later pleads a new or different issue,” remarked Parkar’s lawyer Shyam Keswani.

“The court could not divine what police has based its case on. If the court is not made aware of this letter, it will not be able to consider it when giving its orders,” Keswani added

The prosecution had come to court to cancel the bail granted to six of the eight accused in this case of cheating , extortion and forgery filed against the Parkar, Shuklas, and some alleged associates of Parkar.

The case was registered on April 21, 2007, five months after the complaint was filed on December19, 2006. Complainant, estate broker, Vinod Avalani has alleged that in an agreement for redevelopment of two plots of land in Sion, he/his principal was duped of Rs30,00,000 by the Shuklas in October 2006 and Parkar/ her associates provided the intimidating muscle to prevent recovery of the money.

“Did the prosecution not know of this letter for seven months even though they now claim to base their case on it?” queried a junior lawyer from the defence team.

The arguments will continue on Thursday.
