MUMBAI: When actor Shah Rukh Khan built a building next to his residence Mannat in Bandra, it didn’t seem to have pleased many people.
 
Especially the Brashtachar Nirmoolan Samiti, which has filed a PIL in the Bombay High Court alleging that the BMC has violated the BMC Act, 1888 and the Development Control Regulation (DCR) by allowing the construction area to usurp a 9.15 meter adjoining lane that was to be used for road widening.
 
A division bench of Chief Justice HS Bedi and Justice VM Kanade has directed Khan to file a reply.
 
The road line, the petitioners say, was provided 23 years back by the BMC and it was kept clear for the purpose of road widening. The road leads to the Mount Mary Church in Bandra and is generally overcrowded.
 
“The BMC must issue a public notice or record it in the gazette, if they have taken exception in granting permission. They can’t delete the road line,” Shakuntala Joshi, the petitioner’s advocate said.
