MUMBAI: An amicable settlement is on the cards between Congress leader Sanjay Nirupam and the family of former Union sports minister, the late Sunil Dutt, who had filed a defamation case against the former for levelling allegations during the Lok Sabha poll campaign in 2004, Dutt's lawyer Majeed Memon said on Monday.

"We have held a meeting between Priya Dutt, daughter of Sunil Dutt and Nirupam, and both the sides have agreed to a compromise if Nirupam tenders a public apology. A draft of the consent terms is being prepared and once that is finalised the complaint against Nirupam would be withdrawn," Memon said.

On May 10, 2004, Dutt had filed a case against Nirupam, who had fought Lok Sabha polls from Mumbai North-West constituency as a Shiv Sena candidate, saying that Nirupam had levelled false charges against him by alleging that he (Dutt) had attended Parliament only thrice during his earlier stint as a Member of Parliament.

Dutt said in the complaint that this was absolutely false and produced a letter of the Lok Sabha secretary to show that he had attended Parliament 99 times.

However, Dutt passed away during the pendency of the complaint.

After Nirupam was defeated, he joined the Congress and sent feelers to the Dutt family for a compromise. However, Priya and her sister Namrata did not relent saying their father Sunil Dutt had expressed that he would not compromise under any circumstances, Memon said.

Thereafter Priya and Namrata filed a petition in the court urging that they be made as complainants in the place of their father who had passed away. While their petition is pending, an amicable settlement is being worked out between the two sides, Memon said.
