The residents of Har Siddhi Heights, an 18-storey building in Worli, which has been facing power cuts since May 3, will be inconvenienced for one more week.
Hearing a petition filed by Renuka Shah, a resident of the building, the vacation bench of the Bombay high court on Friday directed the builder — Prithvi Constructions — the naval authorities, the civic body, BEST and the Slum Rehabilitation Authority (SRA) to file separate affidavits.
A division bench of justices Abhay Oka and Mridula Bhatkar also questioned the builder as to how the construction was carried out without an occupation certificate from the civic body.
The BEST had discontinued power supply to the building following a letter from the navy terming it as a security threat.
The judges also noted that the building was completed despite stop-work notice by the state government on September 26, 2008.
Representing the petitioners, senior counsel Raju Subramaniam argued that power companies can disconnect supply only on the ground of non-payment of bill.
According to the BEST, the navy had been raising objection to the SRA project since December 2005.
