Sisters depose against brother in court

In a case where sibling rivalry has spilled out into the public sphere -— where the brother, Lalit D’Souza, allegedly shoot his sister, Lorna, 43, in 2007 — the two sisters have spoken out against Lalit in court recently.

Lalit has been charged with charges of attempt to murder that attracts a minimum sentence of life imprisonment. The case is being heard on a day-to-day basis before additional sessions judge, YG Khobragade. Additional public prosecutor, Nilima Kasture, has already examined five witnesses.

Lorna deposed before the court that when she came home to her

28, 2007 morning, she saw that Lalit’s car was parked on her assigned parking lot. When she asked the watchman about it, the watchman called Lalit to move the car but he came down and abused him.

Lorna deposed that he pinned her down and he pumped in six bullets in her. Her deposition which started on February 18 went on for three court dates.

Her sister, Laura, 41, deposed that Lorna who was conscious after being shot at called her and told her to rescue her and take her to the hospital. The watchman also stuck to her version before the police and said that following an argument, he heard gun shots. A constable who helped Lorna to a taxi that took her to Bombay hospital also deposed before the court. Besides these crucial witnesses, a panch witness who was present at the scene of crime with the Cuffe Parade police deposed.

Lorna was on ventilator till November 10, 2007 and was discharged from the hospital on November 15, 2007. Dr MM Begani, senior surgeon deposed on Friday that he removed two bullets from Lorna’s body. One of the bullets is still lodged near her heart. Two bullets had entry and exit wounds, as per the evidence in the case.

Dr Begani will be cross-examined by defence advocates Harshad Ponda and Junaid Shabwany on April 20. The defence had moved the Bombay high court over the lower court order disallowing certain questions being asked in cross-examination, particularly pertaining to the civil dispute cases pending before various courts.
