High court refuses to let Dawood’s brother go for Haj

Dawood Ibrahim’s youngest brother Iqbal Kaskar will not be able to go for Haj this year. The Bombay high court refused to grant interim order in a petition filed by Kaskar seeking a temporary passport.

Observing that Kaskar had filed the petition at the ‘eleventh hour’ the division bench of justice JN Patel and justice Amjad Sayed refused to grant him relief. “He is only 43 years old, he can go for Haj next year,” said Patel. The last batch of the pilgrims leaves on Monday.

According to his petition, Kaskar was granted permission by the Haj committee in July this year. He moved an application for a passport on August 17, 2009. However, the passport authorities rejected it citing adverse police report. Kaskar then moved a fresh application on October 16, which too was rejected.

He then petitioned the high court on November 16. When the petition came up for hearing on Friday, Mandar Goswami, counsel for the passport authorities, said that they had forwarded Kaskar’s case to the ministry of external affairs and it will take about two weeks to decide.

Kaskar’s advocate Jagdish Shetty requested the court to direct the ministry of external affairs to decide his client’s case expeditiously. The judges refused to incline the request.
The police had seized Kaskar’s original passport after he was deported from Dubai in 2003. Kaskar, who was arrested in the Sara-Sahara case, was acquitted by the special MCOCA court in 2007.

The ministry of external affairs has even put adverse remarks on the passports of Kaskar’s family. The family has been allowed to travel only between India and United Arab Emirates (UAE). The case is still pending in high court.
