The depositions last August of Kanhaiyalal Gidwani, one of the chief promoters of the controversial Adarsh co-operative housing society (CHS), before the two-member commission set up to probe the alleged scam had all the makings of a potboiler.

Gidwani feigned memory loss and sometimes, he did a complete a U-turn from his earlier depositions, the commission had observed.

The deposition of RC Thakur, another chief promoter of the Adarsh CHS, was most likely the nail in Gidwani’s coffin.

He admitted that an undertaking was made with Gidqani, through which he was appointed as co-ordinator to deal with and represent the society, and to co-ordinate with all parties concerned for the exclusive purpose of allotment of land to the society. “It is also mutually and specifically agreed by us, being the office-bearers and managing committee of the society, that at any time in future if the extra floor space index (FSI) and transfer of development rights (TDR) are granted to the society, all such FSI and TDR shall be utilised by the said co-ordinator at his sole discretion for which the said society, its office-bearers and the managing committee members shall have no right or interest in the additional FSI and/or TDR," read the undertaking of June 9, 1999.  

Earlier, in his deposition, Gidwani had accepted that he did not make any reference to the objections raised by the defence estate officer on the development plan affecting the land in question in his letter to the principal secretary of the urban development department (UDD).

He even admitted that in his letters to the chief minister and the UDD, he had given wrong information about the possession of the land of the society.

While exposing former speaker of state assembly Babasaheb Kupekar’s hand in the Adarsh CHS scam to get additional FSI, he tried to save former chief minister Ashok Chavan by changing his deposition again and again.
