Corrigendum a mistake by advocate, admits BMC

A day after the Bombay high court rapped the Brihanmumbai Municipal Corporation (BMC) for publishing a wrong corrigendum saying the court had stayed the tender process for beautification of gardens, the BMC counsel accepted that the mistake was committed by its advocate.

“It was a mistake by my colleague who was in court on July 11, when the court had passed the order restraining the BMC from issuing any further work orders and not staying the tender process itself. I tender my apology for the mistake,” BMC counsel Anil Sakhare told the court on Tuesday.

A division bench of Justice DK Deshmukh and Justice RG Ketkar directed the advocate concerned to file an affidavit  by Monday and if the court was not convinced by the affidavit, it would issue a criminal contempt notice.

While hearing the main petition, the court asked how could the BMC advertise for fresh tenders when existing contracts were on. Sakhare replied: “The fresh tenders are not for present contracts, but for gardens that will be created.”

The court was hearing a petition filed by a six contractors challenging the BMC’s decision to issue an ad asking for fresh tenders. On July 11, the court had stayed further issuance of work orders but the BMC printed a corrigendum saying the tendering had been stayed by the court and it would recommence only after further orders from the court.

When the court suggested the BMC withdraw the tender notice and issue fresh tenders, Sakhare agreed to file an affidavit informing the high court about the status and assured that the BMC would not issue fresh work orders without its order.
