Contempt notice against BMC’s garden dept official

The Bombay high court prima facie held that a gardens department official of the Brihanmumbai Municipal Corporation (BMC) is responsible for the wrong misinterpretations of the court’s order advertising that it has stayed the tender process for beautification of gardens in the city. Thus it is likely that it will issue contempt of court notice against the official.

Division bench of justices DK Deshmukh and RG Ketkar said, “We will be happy if after our order, some officer loses his promotion or has to retire prematurely. We can’t allow our orders being taken causally.”

The court observed, “Our impression is that the explanation given to us is not satisfactory and we are inclined to issue a contempt notice against the officer. We give you a last chance to tender your explanation by August 8.”

Senior counsel for BMC, Anil Sakhare, filed an affidavit and also tendered an unconditional apology to the court. The bench though said “If we don’t take action then it will not be correct.”

The court was hearing a petition filed by a group of contractors who had challenged the BMC decision to issue a fresh advertisement, calling for tenders for beautification of public gardens and others areas in all the 24 wards of the city.

The bench had pulled up the BMC for wrong misinterpretation of the court’s order and sought a detailed reply. The BMC accepted in their affidavit that a mistake was committed by the BMC advocate appearing before the court. The petitioners had challenged the advertisement for fresh tenders being called for contracts that are already on going.
