Constable convicted for attempt to rape in Mumbai

The Bombay high court has convicted a head constable of attempting to rape a minor girl. He was sentenced to ten years in jail. the court also slapped a fine of Rs10,000 on him, which will be paid to the victim.

However, since Chandrakant Pawar, who was accused of raping a minor girl on the night of October 17, 2005, near Hotel Hyatt at Juhu, has already served his prison sentence; he was released from jail.

Justice JH Bhatia convicted Pawar, who was the head constable with the Sahar police, for attempt to rape. Pawar’s charge was reduced from rape to an attempt to rape, the maximum punishment for which is 10 years.

Pawar has spent five years and ten months in prison. Including remission period (leave entitled by a convict which is added as a part of sentence while calculating time spent behind bars), he has undergone nearly 10 years in jail.

Justice Bhatia observed that Pawar was liable to be convicted for attempt to commit rape as evidence on record was not sufficient to establish that actual penetration had taken place and that rape was committed.
