Chief minister Prithviraj Chavan finds himself at the crossroads as the election commission (EC) has failed to issue the notification for the by-elections to the state legislative council on Monday. Chavan has to get elected to one of the Houses of the state legislature before May 11. If he fails to do so he will lose his chief ministerial post.
The EC notifications are issued a month in advance to facilitate the political parties to process their paperwork. The absence of the notification on Monday triggered the panic button in the MPCC which had taken for granted Chavan’s election to the council.
Congress general secretary Sanjay Dutt had resigned last month to pave the way for Chavan’s election to the council.
Sources in the EC said, “The notification has been withheld because of legal tangle. Dutt who offered the seat to Chavan is among the respondent whose names figure in the petition filed in the high court by Shiv Sena MLA Anil Parab. The Sena had challenged the elections of all Congress candidates in the council in June, 2010. It also included the election of Dutt.”
The Sena’s contention was that the Congress revoked the suspension of four MNS members to facilitate their voting in favour of the Congress MLCs. The matter is pending before the high court.
Sources in the election commission said, “Since the matter is subjudice, we cannot start the notification process. We will have to wait for the court clearance in this petition.”
Chavan took the reins of the state government after former chief minister Ashok Chavan was sacked for his alleged role in the Adarsh housing scam.
