‘BMC liable in mishaps due to trenches’

After uproar in lower house over accountability in accident deaths due to ditches, CM decides to hold civic body responsible for it.

Now, the civic body and its officials will be held responsible for the mishaps and accidents that occur on roads due to trenches. Government announced that the compensation will be recovered from the civic officials besides the contractors.

The issue of the deaths due to the trenches dug for various developmental projects was raised in the state assembly during the question hour by Mumbai MLAs on Tuesday. Chief minister Prithviraj Chavan admitted about the accidents that have taken place in the city in the last few months. He said that following the court directives, the compensation was recovered from the contractors of the project for which the trenches were dug. He said that a relative of one of the victims was paid Rs50,000 as compensation.

Jadhav announced in the house that his department will direct the BMC to hold ward officers responsible and recover compensation from them.

He said, “According to the existing rules for the structural projects, the responsibility of taking care of the safety and security and the compensation for the accidents lies with the contractor. The civic body, in the recent mishap, has slapped a show cause notice on the contractor concerned.”

After two deaths in last three months, the petition was filed in the Bombay high court, which is yet to issue its final directives. The petitioner had demanded that the negligence by the civic body be registered as a criminal offence.

The court had is expected to take the view on this during the next hearing, the minister added.

Gopal Shetty said that the compensation of Rs50,000 given to one of the victims is not sufficient and it should be raised to Rs5 lakh.
Jadhav said that since the matter was subjudice in the court, the government and civic body will wait for the court orders and follow the directives.

The Lower house created uproar when minister of state for urban development Bhaskar Jadhav said that the responsibility of the compensation in case of a mishap lies with the contractors. Gopal Shetty, Sardar Tarasigh of BJP, Nawab Malik of NCP demanded the responsibility be fixed on the officers of the BMC as well.

Raising fingers at the negligence of the officers, the MLAs alleged that the officers were being shielded by the government.
