Archeological Survey of India confused over demolition notice in Mumbai

Should it issue the city development authority a demolition notice in the monorail project or wait until the project gets a no objection certificate (NOC) from the National Monuments Authority, is what the Archeological Survey of India (ASI) is contemplating. 

The Mumbai Metropolitan Region Development Authority (MMRDA) is building the Jacob Circle-Wadala-Chembur corridor of the project, which passes near a ancient protected monument at Parel. 

The ASI had earlier issued a stop work notice to the MMRDA, under provisions of the Ancient Monuments and Archeological Sites and Remains (Amendment and Validation) Act, 2010, which prohibits construction work within 300m of monuments. The monorail corridor is close to the ancient monolithic bas relief of Siva in Parel village. 

MMRDA had applied for a NOC from the ASI, which could not be given as the powers, under the act to give an NOC, were delegated to the competent state authority. The application has been pending. 

ASI superintendent, MS Chauhan, said, "After receiving information that the work on the project had started without getting requisite permissions, the only legal recourse left for us was to issue a demolition notice to them and also send them to local authorities, such as the collector and the BMC for carrying out the demolition. However, recently, I wrote a letter to the competent authority, which has reverted saying that the project proposal has been pending with the National Monuments Authority." 

As per the act, only after receiving clarifications from the national authority can the state competent authority grant the NOC. The competent authority has received over 270 applications and is yet to decide on them. These applications are from different state government agencies, private companies and individuals. 

As per the act, the competent authority has to decide within three months the application made to it for procuring NOC for construction.
