Process to lodge case against Rais Khan initiated

The registrar of the Ahmedabad sessions and civil court has initiated the process to register a case against Rais Khan for fabrication of evidence and making false statements at the appropriate magistrate's court.

Sources in the sessions and civil court said the registrar on Monday evening had received all the documents necessary for the case from the special court hearing the Naroda Gam riots case.

Last week, the special court had directed the sessions and civil court registrar to file a case against Khan under sections of the IPC pertaining to fabrication of evidence and making false statements.

Khan is a former aide of Teesta Setalvad, secretary of the NGO, Citizens for Justice and Peace (CJP), which has been fighting for justice to the riot victims.

Official sources in the city civil and sessions court said on Monday that the registrar had received the papers and was going through them before a case against Khan is filed at the appropriate magistrate's court.

Earlier, Khan had filed an application in the special court demanding that he be allowed to turn witness in the Naroda Gam riot case. Witnesses during their deposition had accused him of manipulating and inserting additional paragraphs in their affidavits which were later filed in the Supreme Court.

Serious allegations, including murder and rape, had been levelled against some of the accused in the affidavits which were submitted before the apex court with a plea to shift the trial of the riots cases outside Gujarat.

In his petition filed in the special court, Khan had, however, blamed Teesta Setalvad for the fabrication but the court had rejected Khan's application and ordered the registrar of the city sessions and civil court to file a case against Khan and others under sections 193 to 200 of the IPC.

Sources in the court told DNA on Monday that the registrar, with the help of the public prosecutor, has to decide who, apart from Rais Khan, ought to be charged with fabrication of evidence.

The registrar may include in the list of people charged with fabrication of evidence even the witnesses who had signed on false affidavits, sources said.
