Order on Sanjiv Bhatt’s bail plea today

Additional sessions judge VK Vyas will pronounce his verdict on the bail petition of whistleblower IPS officer Sanjiv Bhatt who was arrested on September 30 in connection with an FIR filed against him by a police constable, KD Panth.

The police constable had accused Bhatt of threatening and making him sign a "false" affidavit supporting his [Bhatt's] presence at a meeting held at chief minister Narendra Modi's residence on February 27, 2002.

After his arrest, the magistrate court refused to grant the police his custody and, instead, remanded him in judicial custody. The IPS officer has been lodged in Sabarmati jail since then.

In his bail petition, Bhatt has alleged that the state government has implicated him in a false case because he had filed an affidavit in the Supreme Court exposing the "role" of the chief minister in the 2002 riots.

He has further alleged that the government is implicating him in one case after another to harass him and his family as he had refused to follow the orders of Modi and the then minister of state for home, Amit Shah, to withdraw some evidence on Haren Pandya's murder.

On the other hand, the lawyer, SV Raju, who was appointed special public prosecutor to oppose Bhatt's bail plea, argued that Bhatt was a "habitual offender". He also accused him of forging documents and forcing Panth to give false evidence under political influence.

Raju had further told the court that the president of Gujarat Congress, Arjun Modhvadia, was as involved as Bhatt in the offence of pressuring Panth to sign a false affidavit.

He alleged that Modhvadia had called Panth when the police constable was at the office of the lawyer who had prepared the affidavits on which he was allegedly forced to sign.
