Meet AMC conditions, says Gujarat high court

The Gujarat high court on Monday directed the owners of the party plots sealed by the Ahmedabad Municipal Corporation (AMC) to fulfill the conditions set by the civic body if they wanted their plots unsealed.

The division bench of chief justice SJ Mukhopadhyay and justice AS Dave gave this order while hearing petitions against the AMC decision filed by the owners of the sealed party plots.

Earlier in the day, the AMC had submitted its reply to the high court’s Thursday order asking it to indicate whether it was willing to unseal the party plots by Monday in the public interest.

The civic body told the court on Monday that it was open to the idea of unsealing the party plots provided the owners fulfilled the set conditions and applied for development permission before October 18. It added that if the plot owners failed in this, the plots would be sealed again.    

On Thursday, the court had also given the plot owners the option to make a representation to the commissioner for interim permission to organise garba programmes at weekends.

Following this, some owners had approached the municipal corporation for relaxation of norms and unsealing of party plots. After its meeting with the party plot owners, the AMC told the court on Monday that it had decided to reconsider the matter only if the owners of the party plots fulfilled the requirements. After hearing both the sides, the court disposed of the case with the direction that the plot owners fulfill the norms and conditions as instructed by the AMC. 

The counsel for the petitioners, however, raised an objection to one of the AMC's conditions - the condition of 'green belt areas' - because the matter is pending before the Supreme Court. At this, the high court stated that the parties in the case should follow the direction of the apex court in the matter of 'green belt areas'. 

Earlier, the civic body had sealed the plots as their owners had not followed construction regulations and failed to comply with the necessary formalities. Reacting to the court order, municipal commissioner IP Gautam said the AMC will follow the high court's order.

"We will unseal the party plots within a week's time, if their owners follow GDCR and approach us with an application," he said. The AMC has chalked out three criteria to decide whether a party plot should be unsealed. First, the party plot should be spread over 2,000 sq m or more; second, it should be located on an 18-metre-wide road; and third, plot owners should submit their development plan to the AMC's estate department by October 18.
