Sadananda Gowda, in a letter to Chidambaram said, the 'unilateral decision' by the government to constitute NCTC infringes upon the powers of the state governments.
BJP ruled Karnataka on Wednesday urged the Centre to postpone launch of the National Counter Terrorism Center from March 1 and hold consultations with the states, while reiterating its opposition to the union government decision on the issue.
Chief Minister DV Sadananda Gowda, in a letter to Home Minister P Chidambaram said, the "unilateral decision" by the Government of India to constitute NCTC infringes upon the powers of the state governments.
He said he is conscious that extremism and terrorism are serious threats to the country and that under similar circumstances, USA set up its NCTC in the aftermath of World Trade Centre disaster. "However, the types of federalism in the United States of America and that of India, though comparable, are not identical", Gowda said.
He said police and law and order are subject matters within the jurisdiction of state governments.Inspite of it,the proposed NCTC with powers to make arrests, carry out searches and seizures and ask for information from any agency would amount to violating the basic rights of the States.
That being so, such a measure should have been properly discussed with states and their views taken into account. No such consultation was held nor views of the State Government ascertained before NCTC's scheduled launch on March 1.
Gowda said on this point, almost all Chief Ministers of different states have expressed strong reservations and opposition to the proposed move."This is definitely one of the subjects which must be discussed and finalised in the National Security Council meeting.Since that has not been done,I hereby oppose any such unilateral launch of NCTC", he said.
Gowda said he agreed with all Chief Ministers of various states who have expressed their opposition to this move.
"At best, the proposed launch of NCTC on Mar 1 2012 should immediately be postponed pending consultation with the states and the National Security Council meeting may be convened at the earliest to discuss this and other related issues",he said
"I hope you would agree with my view and postpone the launch of NCTC until it is discussed with the state Governments".
