The state government has filed a caveat in the Gujarat high court to prevent people from seeking a stay on the new jantri rates that came into force in the state from April 1, 2011. A caveat is a prayer to the court not to pass any order without first hearing the applicant.

Sources said that the government had taken the precaution of filing the caveat in view of the strong reaction among real estate developers and other stakeholders to the new jantri rates.

The state government has filed the caveat against the Confederation of Real Estate Developers Association India (Credai), Gujarat, and other associations of real estate developers. When contacted by DNA, Jaxay Shah, president of Credai Gujarat, confirmed the development.

Meanwhile, the government has formed a committee, chaired by the district collectors of the respective districts, for fixing jantri rates for areas not covered by the survey. The government has also asked the deputy collector of stamp duty valuation to prepare a proposal regarding the printing, typing, calculation, data entry or clerical errors that may have crept into the jantri rates implemented from April 1, 2011.

The office of deputy collector of stamp valuation will also have to complete, within 30 days, the survey of areas not covered by the new jantri, and send its findings to the state government for approval. Moreover, the process of preparing proposals regarding errors of any kind has to be completed within 15 days. The district-level committee has been authorised to discuss and approve the proposal.

In view of the doubts being expressed regarding the method adopted for preparing the new jantri, the spokesperson of the revenue department issued a statement saying that suggestions were received from all stakeholders in this regard. The stakeholders whose suggestions were received included developers, industries, financial institutions and associations at the district level, the official statement said. Moreover, rural and urban areas had been divided into many 'value zones' for preparing jantri ASR 2011.

The statement further said that the government had valued residential open plots, flats, shops and offices, industrial open plots, agriculture land and non-agriculture lands differently as per their location and market prices. A re-survey was also conducted on the suggestions of the cabinet sub-committee, the statement added.
