Gujarat government warns notaries

CJ Gothi, joint secretary in the state legal department said that they have received several complaints about the illegal activities and misuse of power by the state government appointed notaries.

With incidence of serious fraud and irregularities in legal work by the state government appointed notaries on the rise, the state legal department has issued new instructions for the same.
It has asked around 1400 notaries in the state to act as per the rule and not indulge in any illegal activity.

CJ Gothi, joint secretary in the state legal department said that they have received several complaints about the illegal activities and misuse of power by the state government appointed notaries. "On the basis of the complaints we have initiated criminal action against three notaries and an inquiry is on against 10 others," he said.

Gothi said if evidence is found about the alleged illegal activities of the notaries action will be taken for the same.

Gothi said malpractice in fees charged by the notaries was also found. "Many notaries do not give a receipt of the notaries' documents and they don't even keep a register or double registers," he said.

Gothi said according to the rule it is mandatory that notaries put up a board prescribing fees.

"Notaries cannot work except in areas that they are authorised by the state government."

He said many were using their powers to create fake documents and will.

Gothi said instructions have been given to notaries to put up a notary fee board and charge people as per government rules.
He said they have also been asked to issue receipt and maintain register.

"People can approach us if they have any complaint against any notaries. If any notary is found violating the rules, their licence will be suspended and legal action will be taken against them," said Gothi.
