Disgraced Indian diplomat Madhuri Gupta, accused of passing sensitive information to Pakistani intelligence agents, has moved a Delhi court for the third time seeking bail stating that keeping her inside jail would amount to punishment before trial.

In the application filed in the court of the chief metropolitan magistrate, Gupta, 53, also claimed there was no chance of her absconding from the process of law as she is a permanent resident of Delhi.

"Keeping the applicant behind the bars would amount to punishment before the trial. The police have already filed the chargesheet in the matter and it would take long for the court to start trial in the case," Gupta's counsel Joginder Dahiya said, seeking the court to free her on bail.

In the plea, she also claimed all witnesses in the case are her superior officers posted outside the country and so there was no chance for her influencing them as well.

Her application is to come up for hearing tomorrow.

This is the third time that Gupta has filed her bail application in the trial courts.

Her plea had earlier been dismissed by the CMM and a sessions court.

The Delhi police had filed the chargesheet against IFS officer on July 20 seeking her prosecution under Official Secrets Act and Indian Penal Code.

The probe agency had cited Gupta's purported e-mails to claim that she used to pass on information to Pakistan intelligence agencies through her handler Jamshed, whom she reportedly planned to marry, and Mubashar Raza Rana.

Gupta, posted as second secretary, press and information at the Indian High Commission in Islamabad, was arrested on April 22 by the Delhi Police's Special Cell on the charge of revealing classified information to Pakistani officials.
