Sending a strong signal to those who make false statements in court and waste the judiciary’s precious time, the Delhi high court on Thursday ordered an investigation against a man who dragged a false case for six years.

Justice JR Midha directed Delhi Police to investigate a case against Sanjeev Mittal, who had filed a probate case on the basis of a forged will.

Mittal had filed a probate petition for a property in Greater Kailash. The former owner of the same property, a widow, had in her will left the house to her nephew who had taken care of her till death. But the nephew could not take possession because of problems in registration.

On learning this, Mittal filed the petition which was contested by the nephew and when the case came up for trial he stopped appearing in court, refraining even the original owner from occupying the house.

The court in its voluminous judgment considered the law and procedure for making complaints or prosecuting those who have made false statements.

“This case demonstrates the extent and type of malaise which clogs the wheels of the justice delivery system,” the judge said.

“Filing a petition based on false statements and carrying it forward for six years prima facie amounts to a criminal contempt of the court,” the court said while directing the police to charge Mittal for perjury.

Controversies arising out of such false statements are dragged on for years in the hope that the other side will succumb to buy peace. If the other side does not settle for it, in the end, he is hardly compensated and remains a loser, the court said.
