Cheating case against BMW India

Police here have registered a cheating case against automobile major BMW India Pvt Ltd for allegedly supplying defective vehicles.
       
The Andhra Pradesh High Court, hearing a petition filed by BMW seeking a stay on police investigation, today posted the matter to March 22.
       
The case was registered in December 2009 under IPC sections 418 (cheating with knowledge) and 420 (cheating and dishonestly inducing delivery of property) against BMW India, some of its directors and Delta Cars Pvt Ltd (then BMW dealer for Hyderabad) on a complaint filed by GVR Infra Projects executive director G Pavan Kumar in September last.
       
In his petition, Kumar, who has bought a BMW Series 7 car, said the vehicle has problems related to steering and wheels. He told the police that his enquiries with the car company revealed that problems were common and the company was aware of the issue. Despite this, the company was selling cars to unsuspecting customers across the country, he said.
       
During probe, the police said none of the company dealers provided any information citing confidentiality.
       
After the complaint, the BMW approached the High Court and requested it to order the police to stop investigation, and drop sections 418 and 420. The company argued the matter was a consumer dispute and not criminal in nature.
       
The HC had asked the police not to arrest any company officials until further orders. A local jewellery dealer had also filed a similar complaint against BMW last year.
