BJP may drag J&K govt, Centre to court

As a fallout of the aborted Ekta Yatra, BJP is considering taking legal action against the Jammu and Kashmir government although it holds Union home minister P Chidambaram equally responsible for using strong-arm tactics against its leaders and workers in preventing them from entering the state.

Apart from assessing legality of imposing section 144, which prevents gathering of more than five people, the party is considering various other factors to prepare a legal case.

Another significant factor that could become the focus of the case would be the illegal detention of its national leaders — Sushma Swaraj and Arun Jaitely — for six hours.

BJP insiders said a detailed study of the events is being conducted. The other key points in the case could be “forcible retention” of a private aircraft at Jammu airport that was carrying the party’s senior leaders and “hijacking” of the train that was bringing BJP’s youth wing activists from Karnataka to Jammu and Kashmir.

The source said the private airliner was not allowed to take-off after dropping BJP leaders at Jammu. “The pilot was taken to a hotel and was permitted to take-off only after more than 24 hours of landing in Jammu,” he said. The party is also trying to find out who gave directions to divert the Jammu-bound train from Karnataka, the source added.

“Declaring Kashmir a prohibited zone is understandable, but we are trying to fathom as to why Jammu was declared so,” the source said.

BJP said Omar had tried to tell separatists that he had stopped them from entering the Valley.
