Bike modifier granted bail after week in jail

Anand Brahmbhatt and Kinjal Brahmbhatt, Jimmy’s advocate said that under article 22(2) of the Constitution, if any person is detained by police in any crime he has to be produced in court within 24 hours.

Jimmy Sharma, a city-based motorbike modifier who was unlawfully detained by crime branch officials for more than a week, was released on bail on Thursday after the metropolitan magistrate GM Patel intervened in the matter.

Patel ordered the crime branch officials to do the needful matter after Jimmy’s father Pradeep Sharma faxed letters to the chief justice of Gujarat SJ Mukhopadhaya, chief minister Narendra Modi and police commissioner, SK Saikia about his son’s illegal detention. Pradeep also brought the matter to the notice of metropolitan magistrate, GM Patel under whose jurisdiction crime branch cases come.

Anand Brahmbhatt and Kinjal Brahmbhatt, Jimmy’s advocate said that under article 22(2) of the Constitution, if any person is detained by police in any crime he has to be produced in court within 24 hours.

“However, in this case, Jimmy who was picked by crime branch officials on the night of December 14 for alleged theft and sale of more than 41 bikes from different parts of city was not produced in the court even after a week,” the said.

Crime branch picked Jimmy stating that they needed his help in investigating a case.
However, the crime branch didn’t let him go despite his father Pradeep, a retired government officer’s repeated plea. Brahmbhatt further said that the crime branch also failed to produce him in court. Later, on December 21, Sharma brought the matter to the metropolitan magistrate’s notice.

On December 22, the crime branch produced Jimmy in the court and later handed over
his custody to Shahibaugh police for the alleged theft of 13 bikes.  On Thursday, the Shahibaugh police produced Jimmy at the metropolitan magistrate court and sought five days police remand. However, the court rejected the police remand and released him on bail.
