Kanpur: Four boys aged between 6 and 12 accused of 4-year-old girl's gangrape, sent to 3-day remand

Four minor boys, aged between 6 and 12 years, who allegedly gang-raped a 4-year-old minor girl after watching porn films on a mobile phone in Maharajganj area of Kanpur district, were sent to the Juvenile Home for counselling after their three-day remand.

Four minor boys, aged between 6 to 12 years, allegedly gang-raped a 4-year-old minor girl after watching porn films on a mobile phone in Maharajganj area of Kanpur district, were sent to the Juvenile Home for counselling after their three-day remand.

Arrested under the POCSO Act, the four boys were produced in the Juvenile Court on Tuesday by the Kanpur Police. The Juvenile Court gave the police three-day remand for their counselling. “They have been sent to the Juvenile Home for counselling by a child psychiatrist for three days as per the court's order,” said A.K. Meena, the SSP Kanpur.

The four had watched porn content on a mobile phone and lured away a 4-year-old girl playing outside her home. They took her to a vacant plot nearby and sexually assaulted her. When the girl did not return home, family members launched a search and found her lying nude in an unconscious state.

She was rushed to the hospital. After regaining consciousness, she narrated her ordeal and told names of the four boys to the father, who lodged a case on Monday at Maharajganj Police Station. The Police acted swiftly and arrested the four minor boys on charges of alleged gang rape. A medical examination of the girl was also conducted by a panel of doctors.

The Kanpur Police claimed that her vagina was found intact in the medical report, perhaps the minor boys could not penetrate it. “They seem have got excited and indulged in fondling her genitals and blow job after failing to penetrate,” claimed the Kanpur Police.

After going through the medical report, now the Kanpur Police is baffled over slapping POCSO Act against the tenderly aged boys. But experts feel that their actions may come under the non-penetrative category of sexual abuse, hence they can be tried under the POCSO Act. 

The Kanpur Police has sought legal opinion in the case, involving minor victim and minor accused. It will go ahead in the case as per the legal advice. The four boys will remain in the Juvenile Home till then.
