The special Lok Ayukta court hearing the multi-crore Karnataka Industrial Areas Development Board (KIADB) scam on Thursday posted the case to July 28.

Former IT&BT minister Katta Subramanya Naidu, his son Katta Jagadish and other accused were present in the court during the six-hour long arguments by their counsel and the special public prosecutor. The six accused are facing charges of committing irregularities in allotment of KIADB land.

Senior counsel CV Nagesh representing Subramanya Naidu and Jagadish argued that the whole case was motivated with malafide intention. He submitted that it was not a case where bail should be denied and accused needed to be sent to jail pending trial.

Secondly, in the backdrop of petitions filed by the accused (Jagadish) seeking quashing of FIR and all further proceedings in three cases still pending before the high court, he was entitled to be released on bail. The cases filed by Lokayukta police revealed “vendetta and malafide intention”.

Opposing the bail pleas, the special public prosecutor pointed out that private firm ITASAC Software Company, whose managing director Srinivasa is the third accused in the case, had applied for allotment of 385 acres of land on August 24, 2006 and the matter was cleared in just four days by the state high-level clearance committee.

For former KIADB land acquisition officer TP Muninarayanappa, senior counsel Ravi B Naik argued that registering the case itself was bad in law. He also brought to the notice of the court that Muninarayanappa had been granted anticipatory bail.

Special judge Sudheendra Rao adjourned the case to 28 July for the further hearing of the case.

Nine persons, including Subramanya Naidu, his corporator son Jagadish and another councillor M Gopi, were chargesheeted by Lok Ayukta police in connection with the KIADB land scam.

Following the submission of the chargesheet, a Lokayukta special court had issued summons to the accused to appear before the court.
