Karnataka HC given list of 67 MLAs allotted ‘G’ category sites

The allotment took place during BS Yeddyurappa’s term as the chief minister.

S Vasudeva, a local advocate, on Wednesday submitted before the high court two documents, which contained a list of 67 MLAs who were allotted ‘G’ category sites, although they were already owning houses.

The allotment took place during BS Yeddyurappa’s term as the chief minister.

In his public interest litigation petition, Vasudeva had challenged the allotment of sites saying that the lawmakers were not entitled to the sites.
The two PILs were filed on December 12, 2009 and June 7, 2010.
Apart from questioning the allotment, the petitioner said that some of the MLAs had been allotted sites for the second time.
The petitioner also questioned the allotment of ‘stray sites’ under ‘G’ category contending that since the BDA Act of 1976 did not define
‘stray sites’, the Bangalore

Development Authority could not presume that all residue sites remaining with them were ‘stray sites’ and dispose them of.
Pointing out that 64 sites had been provided to the ruling party MLAs and MLCs, the petitioner termed that the allotment as arbitrary, discriminatory, illegal and motivated by extraneous consideration.

The petitioner also contended that the sites had been allotted to seven ministers, five MPs and 12 MLCs.

A total of 72 sites had gone to these MLAs, bureaucrats and their family members and to one sitting judge of the Karnataka high court.

The case has been listed for final hearing next week.
