Devusinh withdraws plea against Dinsha

He had challenged counting results of a particular EVM.

BJP MLA from Matar, Devusinh Chauhan, who lost the Lok Sabha election to Dinsha Patel of the Congress from Kheda constituency, has withdrawn his petition challenging the vote counting process with respect to one particular EVM. He had moved Gujarat High Court soon after counting was over on May 16.

“We have withdrawn the petition from Gujarat High Court,” said Chitrajit Upadhyay, Chauhan's counsel. He said that they would file a fresh petition after making certain amendments in the petition filed earlier.

Dinsha Patel, a former minister of state for petroleum, won the election against Chauhan with a narrow margin of 846 votes. But Chauhan raised doubts over the counting process and alleged biased behaviour of election officials during counting.

The election result of the Kheda constituency had been delayed as the EVM of booth no 76 of Dholka assembly segment under Kheda constituency had become faulty. An expert from Bangalore had to rush to put the machine in order for counting of the votes from that particular EVM. Chahuan had submitted in the petition that the victory margin of Dinsha was narrow and he (Chauhan) could get justice if recounting was ordered by the high court.
