Some residents of Bopal and Ghuma are unhappy even after the high court on Wednesday passed an order that the Ahmedabad Urban Development Authority (Auda) should clear all applications for building use (BU) permission by the residents of the two localities.

The high court has set the deadline of June 30 this year for the Auda to clear the applications. Clearance of applications will regularise any encroachment or extension and pave the way for provision of water supply and drainage facilities in the two areas.
Reacting to the verdict, a senior official of Auda said, “We are ready to clear applications for BU permissions, but it will be subject to the fact that buildings and houses are legal and as per the norms.”

However, for clearance of applications, the applicants will have to pay the requisite charges. When the Auda official was asked who would be responsible for paying fee if the developer of any housing society or scheme was at fault, he said it was not their lookout as the person dwelling in a particular property would be responsible for it, and not the developer. The fee would be used only for their benefit, he said.

However, some residents of Bopal said with anguish why should they pay the fee for BU permission if it was supposed to be paid by developer. Shivlal Purohit, a resident of Binnori Bungalows in Ghuma who had moved the HC against Auda, said, “The HC order is in our favour. However, when we are not at fault, why should we pay our hard-earned money for BU permission?”

Purohit added that it was developers’ responsibility to pay for BU permission. “So, Auda should catch hold of them, and not us,” he said.
