’02 riots case: State seeks separate charge-sheets for Hindus, Muslims

The state government has filed an application in one of the 2002 riots cases, wherein charges were framed against former BJP MLA from Rakhial, Jitendra alias Jitu Waghela, seeking separate charge-sheets against members of the Hindu and Muslim communities who had taken part in the riots. A single charge-sheet had been filed in the case against Waghela and 43 others.

The accused were charged with violence, rioting and the killing of one person on March 31, 2002, during a communal clash at Gomtipur. Waghela was charged with inciting the mob that had turned violent. A case was then registered against the accused by then police inspector NR Jadhav.

According to the application filed in the sessions court by additional public prosecutor RC Trivedi, the accused belonging to each community had “conflicting objectives”. The application said that members of the Hindu community had wanted to cause damage to the Muslim mob, and vice versa.

However, lawyers Anand Brahmbhatt and Kinjal Brahmbhatt, representing the 13 accused from the Hindu community, submitted that though they did not object to separate charge-sheets, the charges of murder should be removed. They submitted that of the two people killed in the communal clash, one of them, Ashrafkhan Pathan, was killed in police firing, while the other, Vasantkumar Parmar, was stabbed. The lawyers contended that the 13 accused had not played any role in their murder. Additional sessions judge PR Patel deferred further hearing in the matter till April 13.
