A court will hear on Monday a petition of a person, picked up on charges of being a terrorist but cleared by the CBI, as he claimed that he was beaten by inmates inside the high security Tihar jail, an incident which took place barely two days after he sought intervention of prime minister Manmohan Singh for relief.

The additional sessions judge S K Gautam, while hearing application Irshad Ali, had asked the Tihar prison officials to submit their report.

Ali's lawyer Suffian Siddiqui has also moved a petition seeking permission to meet his client and later seek justice. Ali along with another person Mohammed Moarif Qamar was arrested by the Delhi Police with the help of an Intelligence Bureau official and labelled as terrorists of Al-Badar militant outfit.

However, the CBI had found them to be innocent and had sought prosecution of three Special Cell officers of Delhi Police for falsely implicating them.

"I want adequate protection for my clients as I fear for their lives. They have only sought justice," Siddiqui said.

In his application, Ali sought his medical examination as he was "thrashed" inside the Tihar jail here by two inmates identified as Ashok and Sonu. He also demanded an inquiry into the matter to find out as who was behind the attack on him
which occurred in jail number three between 1800 and 1815 hours on Saturday.

Ali, labelled as a terrorist by Delhi Police's Special cell, had requested the prime minister to take necessary steps as the police, accused by the CBI of falsely implicating him, was allegedly threatening him inside the Tihar prison to withdraw the case.

In his emotional three-page letter written in Urdu, Ali, who remains in custody despite getting a clean chit from CBI on November 11 last year, had said: "Nainsafi hi dehshatgardhi ko janam deti hai (injustice gives birth to terrorism)."

He alleged that officials of the Special Cell were sending messages warning him of dire consequences if the case was not withdrawn.

Ali said in his letter that he had worked as an informer with the Special Cell and Intelligence Bureau for five years. "However, I ran out of my luck when I sought remuneration for my work. I was picked up and labelled as a terrorist...my three children are not able to go to school. My old father and wife are suffering immensely," Ali said.

In a strongly-worded report, the CBI said nothing adverse had been found against them and recommended action against at least three officials of Delhi Police -- Vinay Tyagi, Ravinder Tyagi and Subash Vats -- for implicating them wrongly.

The CBI, in its closure report, alleged that the three officials of the anti-terror cell of Delhi Police "operation" be booked for lying under oath and creating false evidence, among other serious offences.
