Demoted ASIs knock on Guj high court doors

They now stand to lose the chance of becoming a PSI or even appear for the GPSC exams.

Six assistant police sub inspectors fear their hopes getting dashed when the department has demoted their two earlier promotions and brought them back to their original posts as constables.

Their fears has also taken Mumtaz Ajmeri and six other police personnel to the Gujarat high court and file a writ petition against the revocation of their posts. Justice Kalpesh Jhaveri has issued notices to the various authorities, including the range inspector general of police, seeking explanation of the issue and kept further hearing on the matter for February 5.

According to details the police department this week revoked its earlier promotion orders from ASI to constable for 10 police personnel. Out of them, six ASIs including a woman constable, Mumtaz Ajmeri, are preparing for a GPSC examination to be held to fill up the posts of police sub inspector in the state police department. The petitioners have spent over 10 years to become ASI on the basis of seniority as well as merit.
Now, once the department has dropped them to the position from where they had begun when they joined the services, they will also lose their eligibility and chance to become a PSI.

“The seven police personnel were promoted to ASI during their services according to their seniority and merit of performance in their training,” submitted Rashmin Jani, their counsel, adding, “First they were promoted to the post of head constable and then to ASI according to a circular issued by the police department in 1997.”

“Shockingly, the department this week issued an order, revoking the promotions and brought them back to their original posts on basis of a circular of 1989,” he said.

Jani further submitted that, “The department has instructed the petitioners that they will be given promotions on basis of merit only and not on seniority. Actually this act is a violation of the police manual rule 70(8) and 70 (11). By issuing a circular in 1997, even the department itself had decided to give promotion both on basis of seniority and merit.”
