NEW DELHI: An authorised auto dealer can be hauled up for deficiency in service if a newly-bought vehicle develops a defect, the Delhi Consumer Commission has said while directing a Telco dealer to pay Rs two lakh to a Tata Safari owner.
   
The Commission directed the authorised dealer of Tata Engineering and Locomotive Cooperation Limited (Telco) to pay Rs two lakh compensation to Rajiv Gulati who suffered due to persistent defects in his Tata Safari.
    
"Whenever a consumer decides to purchase a brand new vehicle at high price, the minimum expectation of that person is that he would not face inconvenience or physical discomfort or financial loss for getting the defects removed every second day," Commission President Justice J D Kapoor said.
    
"In our view, a lumpsum compensation of Rs two lakh meet the ends of justice," the Commission said while accepting Gulati's plea.
    
The Commission, comprising member Rumnita Mittal, observed that if the consumer would suffer mental agony despite going for a costly brand new vehicle, then the "very intention" of purchasing it goes in vain.
    
"Otherwise, the very intention of a consumer to go for a costly brand new vehicle shall suffer such a blow that he would deem himself as a subject of injustice," Justice Kapoor said.
    
The Commission's decision came after Delhi-resident Gulati approached it, seeking Rs 11 lakh compensation for inherent manufacturing defects in Tata Safari that he purchased in 2000 from the authorised dealer which persisted despite numerous attempts to rectify it.
