'Pay Rs one lakh compensation to lawyer'

NEW DELHI: The Delhi Police have been directed to pay a compensation of Rs one lakh to a lawyer, who was injured due to their high-handedness following his alleged violation of the prohibitory order during a demonstration held by the advocates.
    
In a recent judgement, Justice A K Sikri dismissed an appeal filed by the police challenging the civil judge's order granting award of Rs 1,12,500 to Yash Pal Sharma, a practising lawyer from Patiala House court, as compensation and slapped a litigation cost of Rs 15,000 on the police department.
    
"It is manifest that the police exceeded its powers and saw occasion to teach the lesson to the demonstrators, of which plaintiff (Sharma) became the worst victim," the court observed.
    
Terming the police act as "punitive and repressive", the court agreed with the finding of the civil judge that the "police was not justified in using the kind of force it used which was far from reasonable."
    
According to Sharma, on February 25, 1993 the Commissioner of police had issued an order under section 144 of Cr PC declaring a specific area of Patiala House Court as 'prohibitory area' for the lawyers who were staging a demonstration.
    
He said that police had used the cane charge during which one of the lawyers J P Dixit was beaten up mercilessly. To save Dixit from police excesses, Sharma broke through the cordon of policemen and some how managed to reach the boundary of the court complex.
    
At that time, the police had showered cane blows on him. As a result he had received severe injuries all over his body, Sharma claimed.
